François Defaix (1959) is Chairman of the Group of Practice and directs the Working Law Working Groups at the various branches in this capacity. His practice consists of both collective and individual labour law (process).
He specializes in collective redundancies, reorganisations - including the preparation of social plans and negotiations with trade unions - international labour law, due diligence and takeovers (including related pension cases) and company transfers.
He also frequently acts as counsel to the board for management, board of directors and supervisory board of (exchange) companies in the appointment, suspension and dismissal of (statutory) directors. François also has extensive experience in all aspects of the introduction of collective agreements and participation law (Law on Works Councils). He frequently advises management and management of (large) companies on requests for advice and consent and the role of the Works Council in mergers and acquisitions.
He is a member of several professional associations, as well as board member of the Association Rotterdam Labour Law Lawyers (VRAA) and board member of the Franchise Association Association Affiliate Companies HEMA [VAB].
François regularly teaches and publishes on labour law issues.
François Defaix (1959) is praktijkgroepvoorzitter en stuurt in die hoedanigheid de praktijkgroepen Arbeidsrecht op de verschillende vestigingen aan. Zijn praktijk bestaat uit zowel collectief als individueel arbeids(proces)recht.
Hij is gespecialiseerd in collectief ontslag, reorganisaties - inclusief het opstellen van sociale plannen en de onderhandelingen met de vakbonden - internationaal arbeidsrecht, due diligence en overnames (inclusief daaraan gerelateerde pensioenzaken) en overgang van onderneming.
Hij treedt daarnaast veelvuldig op als 'counsel to the board' voor directie, raad van bestuur en raad van commissarissen van (beurs)vennootschappen bij de benoeming, schorsing en ontslag van (statutaire) bestuurders. François heeft eveneens ruime ervaring met alle aspecten rond de introductie van collectieve arbeidsovereenkomsten en medezeggenschapsrecht (Wet op de Ondernemingsraden). Hij adviseert veelvuldig directie en bestuur van (grote) ondernemingen met betrekking tot advies- en instemmingsaanvragen en de rol van de Ondernemingsraad bij fusies en overnames.
Hij is lid van diverse beroepsverenigingen, alsmede bestuurslid van de Vereniging Rotterdamse Arbeidsrecht Advocaten (VRAA) en bestuurslid van de Franchisevereniging Vereniging Aangesloten Bedrijven HEMA [VAB].
François doceert en publiceert regelmatig over arbeidsrechtelijke onderwerpen.
