About

Marc Wintgens (1961) has extensive experience in the field of private law construction and property law, with a special focus on complex issues involving both government and private parties. He works, inter alia, for municipalities, housing corporations and care institutions, as well as for large project developers, contractors and investors. Marc is considered to be one of the top specialists in his field, as evidenced by the international rankings - including the Chambers and the Legal 500 - in which he is named, as well as the fact that he was elected by his fellow lawyers in 2008 in the top 3 of the best real estate lawyers in the Netherlands.

In the construction law, he has dedicated himself to the preparation of complex construction contracts relating to the design, construction, financing, management and/or maintenance of large buildings (to size or for example on the basis of the DNR 2005 and/or the UAV-1989 or the UAV-GC 2005). In this context, he has drawn up, inter alia, DB(F) MO contracts for the financing, creation and maintenance of integrated projects, utility constructions, infrastructure works and broad schools and is engaged in the preparation of all the necessary contract formations for the realisation of large-scale housing, utility construction and infrastructure projects.

In addition, one of his specializations is risk management during the implementation phase of government-related or Anglo-Saxon cut construction projects (liability issues, multi- and less-work claims, construction stagnation, financial disputes, risk management, etc.). He also has extensive experience in litigation at the Council of Arbitration for Construction, the Netherlands Arbitration Institute (NAI) and Courts, in which he acts both for (public-related and large private - often internationally operating -) clients and for project developers and contractors.

In real estate law, he has dedicated himself to real estate transactions and project development and related contracts, such as Public Private Collaborations (PPS-en). In this context - both on behalf of government-related clients and private parties - he conducted negotiations and drew up contracts in very complex and extensive real estate developments in the Netherlands. In such projects, he often works closely with other disciplines within AKD, such as the disciplines of Administrative Law, European and Competition Law and Company Law.

Marc has several publications in his name, including the UAV-1989 and the Right of Retention. In addition, Marc regularly teaches - internally and externally - in the field of UAV-1989, PPP contracts, DB(F)MO contracts, real estate contracts at healthcare institutions and construction and real estate law in general. Marc is also a member of the Association for Construction Law and the Association for Construction Law attorneys. Within AKD, he leads the discipline of building and real estate law as department chairman.
