R. v. P.P. – First degree murder. Client hit his brother-in-law in the head with a metal bar which caused his death. At trial, my co-counsel, Steven Stauffer, and I established that:

b) His brother-in-law was one key element in this complex trauma history; he had severely assaulted our client in the past and was convicted for it.

c) Client had repeatedly tried to avoid contact with his brother-in-law in the incident lead-up.

d) Client did not have the mens rea (planning and deliberation) for first degree murder.

Client found not guilty of first degree murder (only guilty of manslaughter.) He was spared a life sentence and after receiving credit for his pre-trial custody, he walked free.
