About

Deacon, Spears, Fedson + Montizambert 2300 Yonge Street Suite 1901 Box 2384 Toronto, Ontario Canada M4P 1E4

Blaine has represented and advised condominium corporations for over 30 years. He provides a full range of services in condominium law for clients, whether older or newly registered condominium corporations.

Blaine is experienced in arbitrating shared facility and other disagreements, working with expert engineering witnesses, and resolving construction deficiencies and claims against Tarion and builders under the Ontario New Home Warranties Plan Act .

Blaine argued the Ontario Court of Appeal decision of Newport Beach that established the process available to condominium corporations in Ontario to pursue construction defect claims against Tarion and developers in court, rather than to the License Appeal Tribunal where reimbursement of legal costs and engineering expenses and other advantages may not be available. Newport Beach has now been cited 40 times, including 12 times by the Court of Appeal, which has called Newport Beach the “leading authority” on the scope of the Ontario New Home Warranties Plan Act ( Baradaran v. Tarion Warranty Corporation , 2014 ONCA 597, at para. 36). Tarion’s lawyers called it “an especially important one for owners of new homes in Ontario – including not only condominium corporations and unit owners, but also owners of freehold (detached) homes.”

While in some cases litigation is unavoidable, Blaine is pleased when he is able to work cooperatively with opposing counsel and their clients in avoiding expensive litigation and providing cost-effective solutions for our clients.

Blaine and his wife share their home with two demanding cats and a large Shepherd. In his free time he likes to enjoy northern Georgian Bay.
