The employer obtained an LMIA, but the visa office refused the work permit: the officer applied general requirements instead of the mandatory ones. We took the case to a Federal Court hearing, where the Court sided with the applicant and confirmed errors in the officer's decision.
The application was accepted for processing in summer 2022 and stalled without good reason. We began mandamus proceedings and established all the criteria in court, including a response to the security-checks argument. Under pressure from the court proceedings, processing was promptly completed.
The couple had lost their legal status in Canada; by the time they contacted us, they had submitted dozens of applications and received more than thirty refusals. Months went into preparing the arguments and documents for a humanitarian application, which was quickly approved – the couple obtained permanent residence.
Three consecutive refusals for the same reason: the officer did not believe the applicant would return home after the visit. Two applications to Federal Court were needed: after a court order, the authorities reconsidered the case – the visa was issued in September 2023, and the entire process took just over two years.
